West Virginia and other states filed a motion to intervene as respondents, arguing that they had a “direct and unique interest” in the proceedings due to the economic costs of the vehicle emissions standards and the questions raised regarding how climate-related matters should be addressed. They also argued that the federal respondents would not adequately represent their interests, including because they were “in a better position to counter anticipated arguments from other States about the consequences of the Final Rule and climate change for States themselves.”
