Environmental Defense Fund v. Zeldin

Environmental Defense Fund filed a petition for review in the D.C. Circuit Court of Appeals challenging EPA’s April 2026 final rule amending the New Source Performance Standards and Emission Guidelines for Existing Sources for the Crude Oil and Natural Gas Source Category in response to petitions for reconsideration of a March 2024 final rule. EPA described the April 2026 amendments as making “discrete technical changes to the temporary flaring provisions for associated gas in certain situations” and finalizing “discrete technical changes to the vent gas net heating value (NHV) continuous monitoring requirements and alternative performance test (sampling demonstration) option for flares and enclosed combustion device(s).”
