No More Freeways v. U.S. Department of Transportation

A lawsuit filed in federal district court in Oregon challenged the review and approval of a highway expansion project in Portland. The plaintiffs asserted violations of the National Environmental Policy Act, the U.S. Department of Transportation Act, the Federal Highway Act, and the Administrative Procedure Act. Regarding climate change, the complaint alleged that analysis of emissions was contingent on transportation modeling that misused data and erroneously relied on assumptions regarding vehicle fleet composition and turnover that artificially reduced emissions.
