Save Long Beach Island, Inc. v. U.S. Department of Commerce

Save Long Beach Island, Inc. and individual and business plaintiffs filed a lawsuit in the federal district court for the District of Columbia challenging federal authorizations for the Atlantic Shore South offshore wind project. The plaintiffs asserted violations of NEPA, the Endangered Species Act, Marine Mammal Protection Act, the Coastal Zone Management Act, the Outer Continental Shelf Lands Act, and the Administrative Procedure Act. The NEPA claims included allegations that the final EIS failed to provide information necessary for reasoned decision-making, including information about the project’s effect on climate change.
