A plaintiff filed a greenwashing lawsuit alleging that Glad Recycling Trash Bags are deceptively marketed as recyclable. The complaint alleged that the deceptive marketing of the bags resulted in harms to consumers who paid an “unwarranted premium” based on the recyclable claims, endangered recycling plant workers, and harmed the environment by preventing recycling of otherwise recyclable materials. The complaint also alleged that incineration of plastic waste releases substantial amounts of carbon dioxide, contributing to climate change. The complaint asserted violations of the California Consumers Legal Remedies Act, the California Unfair Competition Law, and the California False Advertising Law, as well as an unjust enrichment claim.
