A land trust and several other parties challenged the certification of a revised environmental impact report (EIR) under the California Environmental Quality Act concerning a proposed mixed-use real estate development. Among other things, the lawsuit challenged the EIR’s analysis of sea level rise from climate change. A state trial court dismissed the challenge. On appeal, the state appellate court affirmed, holding that the EIR adequately discussed the impacts of sea level rise from climate change.
