Verified petition for writ of mandate and complaint for declaratory and injunctive relief filed.
A community group filed a lawsuit in California Superior Court challenging the California Environmental Quality Act review for the University of California, Berkeley’s 2021 Long Range Development Plan (LRDP). The final environmental impact report (FEIR) for the LRDP also considered two construction projects, which the petitioner contended should have been subject to separate environmental review after review of the LRDP was completed. Among the petitioner’s claims was that the FEIR was “materially deficient” because it failed to examine the LRDP’s proposed population increase. Greenhouse gas emissions were one of the impacts that the petitioner alleged were not adequately discussed in the FEIR.
