The California Restaurant Association, a manufacturer of polystyrene foam products, and three individuals who own or work at restaurants and businesses in San Diego filed a lawsuit in California Superior Court challenging the City of San Diego's ordinance banning distribution of polystyrene foam containers. The petitioners asserted that the City should have evaluated the environmental impacts of the ban pursuant to the California Environmental Quality Act. They alleged, among other things, that the ban would undermine the City's Climate Action Plan's zero waste goals and that it would increase greenhouse gas emissions because substitutes for polystyrene use more energy and water.
