Two petitions for review were filed in the Second Circuit Court of Appeals to challenge the U.S. Department of Energy’s (DOE’s) withdrawal of a final rule adopted in January 2017 that expanded the types of lightbulbs subject to backstop energy conservation standards that would take effect on January 1, 2020. DOE said the 2017 rule included certain “general service incandescent lamps” as “general service lamps” (the category of lightbulbs subject to the backstop standard) in a manner that was not consistent with the Energy Policy and Conservation Act of 1975 as amended by the Energy Independence and Security Act of 2007. The first petition was filed by 15 states, New York City, and the District of Columbia. The second <a href="https://climatecasechart.com/case/natural-resources-defense-council-v-us-department-of-energy/">petition</a> was filed by six organizations that included environmental, consumer, and public housing tenant groups.
