In its brief responding to the petition for writ of certiorari, the U.S. Department of Energy and other federal respondents agreed with the petitioners that the interpretive rule and the resulting energy conservation standards "reflect an unduly  narrow understanding" of what constitutes a "performance characteristic[]" under the Energy Policy and Conservation Act. The federal respondents therefore contended that the Supreme Court should grant the petition, vacate the judgment below, and remand for further proceedings.
