Beaudry v. City of Montreal (Pierrefonds-Roxboro Borough) and City of Montreal is a proposed class action filed in the Superior Court of Quebec on behalf of all persons whose movable or immovable property in the Borough of Pierrefonds-Roxboro was damaged by flooding during an extreme rainfall event on June 20, 2026. The application alleges that approximately 100–170 mm of rain fell over a period of a few hours, overwhelming local drainage systems and causing extensive flooding of streets, homes, and vehicles. The plaintiff claims that many residences suffered significant water infiltration, including severe basement flooding. The proposed class consists of property owners and lessees affected by the flood, part of an estimated 1,000–1,500 households impacted across Montreal’s West Island.

The plaintiff alleges that the Borough of Pierrefonds-Roxboro and the City of Montreal negligently caused or exacerbated the flooding by failing to adequately prepare for, manage, and mitigate foreseeable extreme rainfall events. Specifically, the claim alleges that the defendants failed to increase stormwater storage capacity before the storm, failed to install or expand flood-adaptation infrastructure such as sponge parks, retention facilities, reservoirs, and catch basins, failed to undertake adequate emergency response measures during the flooding, and failed to upgrade and maintain aging sewer and drainage systems. 

The application further alleges that these failures occurred despite the defendants’ knowledge that climate change has increased the frequency and intensity of concentrated rainfall events. According to the claim, municipal authorities were aware that Pierrefonds-Roxboro's topography makes it particularly vulnerable to surface-water accumulation and had been on notice since the severe flooding associated with the remnants of Hurricane Debby in August 2024 that existing drainage infrastructure could not adequately handle major rainfall events. The plaintiff contends that the municipalities failed to implement appropriate adaptation measures despite being aware of these climate-related risks.

The plaintiff seeks compensatory damages for property demolition, disinfection, repairs and reconstruction, replacement of damaged personal property and vehicles, diminished property value, increased insurance costs, alternative living expenses, and health impacts associated with mold, fungus, and contamination. The plaintiff also seeks damages for pain and suffering, stress and anxiety, loss of enjoyment of life, punitive damages under the Quebec Charter of Human Rights and Freedoms, and injunctive relief requiring the defendants to undertake works aimed at preventing future flooding.


On June 20, 2026, the Montreal region experienced an extreme rainfall event that reportedly brought between 100 and 170 mm of rain within a few hours. According to the application, runoff water overwhelmed local drainage infrastructure in the City of Dollard-des-Ormeaux, causing streets to flood and resulting in extensive damage to homes and vehicles. The proposed class action lawsuit consists of all owners and lessees of movable or immovable property in Dollard-des-Ormeaux that was damaged by the flooding. The application estimates that between 1,000 and 1,500 households across Montreal’s West Island were affected by the event.

The proposed class action alleges that the City of Dollard-des-Ormeaux and the City of Montreal negligently caused or exacerbated the flooding by failing to adequately prepare for, respond to, and mitigate foreseeable extreme rainfall events. The plaintiff alleges that the defendants failed to take precautionary measures before the storm, including increasing available stormwater storage capacity; installing or expanding adaptation infrastructure such as retention ponds, retention facilities, catch basins, and sponge parks designed to absorb, detain, and gradually release rainwater; implementing adequate flood-response measures during the event, including water diversion, pumping, and blockage removal; and upgrading and maintaining aging sewer and drainage systems.

The application further alleges that these failures occurred despite the defendants’ knowledge that climate change has increased the intensity and concentration of rainfall events. According to the claim, the defendants knew that Dollard-des-Ormeaux was vulnerable to flood risk because of its topography and had been aware that existing sewer and drainage infrastructure could not adequately withstand major rainfall events following the severe flooding associated with the remnants of Hurricane Debby on August 9, 2024. The plaintiff contends that the municipalities therefore had notice of foreseeable climate-related flood risks and failed to undertake appropriate adaptation measures.

The plaintiffs allege that class members suffered common injuries resulting from the flooding, including damage to residential property and personal belongings, reduced property values, increased insurance costs or loss of insurance coverage, temporary relocation and other out-of-pocket expenses, and physical and mental harms associated with flood-related contamination. The action seeks compensatory damages, punitive damages under the Quebec Charter, and injunctive relief requiring the defendants to undertake infrastructure improvements and other measures intended to prevent future flooding.


The plaintiff alleges that Procter & Gamble’s “Keep Forests as Forests” campaign, including “Protect-Grow-Restore” messaging, misrepresents the environmental footprint of Charmin toilet paper. Despite marketing the product as environmentally friendly, the suit claims that the paper is produced using widespread deforestation practices. This action is part of a growing wave of Canadian private and class claims targeting greenwashing in consumer products following the 2024–2025 amendments to the Competition Act, which enabled private parties to challenge misleading environmental claims. The case is relevant to climate change as it contests corporate claims about forest protection, sustainability, and environmental responsibility.

In December 2024, a proposed consumer class action was filed before the Superior Court of Quebec against 9199-4467 Québec Inc., doing business as Earth Rated, alleging false and misleading environmental representations in violation of the Competition Act, R.S.C. 1985, c. C-34, and related consumer protection legislation  ￼. The plaintiff, acting on behalf of purchasers across Canada or, alternatively, a Quebec subclass, claims that Earth Rated’s “Certified Compostable Poop Bags” were marketed, labelled, and sold as compostable in circumstances where, in practice, the bags and their intended contents (pet waste) cannot be composted in most municipal composting systems in Canada. According to the application, composting facilities in Quebec and many other provinces either do not accept compostable plastics at all, do not accept pet waste, or mechanically remove and landfill plastic bags during processing, rendering compostability claims ineffective or misleading in real-world disposal conditions.

The plaintiff alleges that Earth Rated leveraged consumer concern about environmental impacts to charge a price premium for these products, notwithstanding the limited availability of composting infrastructure capable of processing them as advertised. The application relies on federal guidance on environmental claims, international standards on environmental labelling, and amendments to section 74.01 of the Competition Act that specifically address representations about environmental benefits and climate change mitigation, including requirements that such claims be supported by adequate and proper testing or substantiation. The relief sought includes authorization of a class action, compensatory and punitive damages, declaratory relief, and an injunction prohibiting continued representation of the products as compostable.

In April 2025, Earth Rated filed an application seeking authorization to adduce additional evidence at the authorization stage under the Quebec Code of Civil Procedure  ￼. The defendant argues that the proposed sworn statement and supporting exhibits correct or clarify what it characterizes as incomplete or inaccurate allegations in the authorization application. In particular, Earth Rated asserts that certain composting facilities in Quebec and elsewhere in Canada do accept certified compostable bags, with or without pet waste, and that the full product packaging contains qualifying language indicating that compostability depends on the availability and acceptance policies of local municipal programs. The defendant submits that this evidence is relevant to assessing whether the plaintiff has established an arguable case, including whether the impugned representations would mislead a reasonable consumer when read in context.

The case forms part of a broader trend in Canada since 2024 toward increased private enforcement and litigation concerning environmental and climate-related marketing claims. Amendments to the Competition Act expanding private access and explicitly addressing claims related to environmental protection and climate change mitigation have coincided with heightened scrutiny of corporate representations concerning compostability, recyclability, offsets, and emissions reductions. While framed as consumer and competition litigation, the proceedings are climate-relevant insofar as they test the legal standards governing claims about environmentally beneficial products and the evidentiary threshold for substantiating such claims in light of existing waste management and emissions-reduction realities.
