Three organizations filed a notice of appeal in the New Jersey Superior Court, Appellate Division, of the New Jersey Department of Environmental Protection’s (NJDEP’s) consistency determination under the Coastal Zone Management Act (CZMA) for the Ocean Wind 1 Offshore Wind Turbine Project. One of the issues identified in the notice of appeal was that NJDEP allegedly` acted outside its statutory authority by considering factors in support of consistency, such as New Jersey’s overall wind or renewable power goals, that are “not included in the CZMA and that bear no direct or obvious relation to the CZMA coastal zone factors.”
