Center for Biological Diversity v. U.S. Fish & Wildlife Service

Center for Biological Diversity (CBD) filed a lawsuit in the federal district court for the District of Oregon to compel the U.S. Fish and Wildlife Service (FWS) to issue (1) 12-month findings under the Endangered Species Act (ESA) on CBD’s petitions to list four species and (2) a 90-day finding on CBD’s petition to list a fifth species. The complaint alleged that FWS had found that CBD’s petitions presented information suggesting that climate change might be among the threats to the Alvord chub (a freshwater fish) and the cinnamon juga, Great Basin ramshorn, and Donner und Blitzen pebblesnail (four species of freshwater snails). Regarding the fifth species, the banded juga (also a freshwater snail), CBD alleged that the species faced threats from impairment of its habitat due to water that is too warm and dissolved oxygen levels that are too low.
