An energy company sought a declaratory judgment that an agreement between it and the Sierra Club pertaining to a liquefied natural gas (LNG) terminal allows it to convert the terminal into an LNG export facility. Specifically, the lawsuit sought a declaratory judgment that the Sierra Club’s effort to block the conversion had no basis under the agreement. Under a series of agreements between the two parties, major changes to the terminal and adjacent areas could not be made without the environmental group’s approval.
