Dominion Cove Point LNG, L.P. v. Sierra Club

The Maryland Circuit Court ruled in favor of Dominion Cove Point, concluding that the agreement permitted construction and operation of facilities for liquification of natural gas and also permitted export of liquefied natural gas from the terminal site.

An energy company sought a declaratory judgment that an agreement between it and the Sierra Club pertaining to a liquefied natural gas (LNG) terminal allows it to convert the terminal into an LNG export facility. Specifically, the lawsuit sought a declaratory judgment that the Sierra Club’s effort to block the conversion had no basis under the agreement. Under a series of agreements between the two parties, major changes to the terminal and adjacent areas could not be made without the environmental group’s approval.
