Harris v. Dominguez

Three lawsuits challenging the NYS Route 33, Kensington Expressway Project in Buffalo, New York, raised claims regarding the New York State Department of Transportation’s (NYSDOT’s) consideration of greenhouse gas emissions and climate change in its review of the project. A lawsuit brought by two individuals who lived near the Kensington Expressway asserted that the determination that the project would not result in significant adverse impacts violated the State Environmental Quality Review Act and the Climate Leadership and Community Protection Act.
