Defendants' motion for summary judgment granted.
The federal district court for the Northern District of California upheld the U.S. Department of Energy's (DOE’s) review of the Computational Research and Theory Facility Project at Lawrence Berkeley National Laboratory under the National Environmental Policy Act (NEPA). Among other things, the court found that DOE had taken a hard look at direct and indirect greenhouse gas emissions and had made a reasonable determination that they would not have a significant impact. The court also said that the plaintiff could not "shoehorn" standards applicable to reviews of greenhouse gas emissions under the California Environmental Quality Act into the federal NEPA review. The court also found that DOE's calculations of emissions were reasonable and not arbitrary and capricious.
