Plaintiffs' motion for summary judgment denied and defendants' motions for summary judgment granted.
Two environmental groups filed an action seeking to block construction of a new highway in northwest Houston, Texas Among other things, the plaintiffs alleged that the final environmental impact statement (FEIS) failed to consider GHG emissions. Both sides moved for summary judgment. The court granted the defendant’s motion, holding that an analysis of GHG emissions was not required under federal law.
