The Massachusetts Superior Court upheld the Massachusetts Attorney General’s February 2022 disapproval of the Town of Brookline’s zoning amendments preventing or limiting use of fossil fuel infrastructure in new construction. The court concluded that the Attorney General had not erred in determining that the local laws were inconsistent with or preempted by other Massachusetts laws.
