Utah Chapter of the Sierra Club v. Air Quality Board

The Utah Supreme Court affirmed portions of the Utah Air Quality Board's order denying Sierra Club's challenges and approving the granting of an approval order for a coal-fired power plant, including the Board's determination that carbon dioxide was not subject to best available control technology (BACT) requirements. The court reversed on other grounds, including because the Board had determined that integrated gasification combined cycle did not need to be considered as part of BACT.
