American Free Enterprise Chamber of Commerce v. EPA

American Free Enterprise Chamber of Commerce filed a petition for review in the Ninth Circuit Court of Appeals challenging EPA’s decision granting California a waiver of Clean Air Act preemption for its Advanced Clean Cars II regulations. The petition was filed on January 6, 2025, the same day that EPA published its notice of decision in the Federal Register. California, 15 other states, the District of Columbia, and several cities sought leave to intervene in support of the respondents, as did three environmental organizations and the Zero Emission Transportation Association, a coalition of companies in the electric vehicle supply chain.
