The Ninth Circuit Court of Appeals affirmed in part and reversed in part and remanded for entry of a preliminary injunction. The Ninth Circuit held that plaintiffs were likely to succeed on their claim that the EIS did not adequately discuss the project’s impacts on elk habitat. A supplemental EIS was therefore required.
