Industry and business groups filed a lawsuit challenging California’s Low Carbon Fuel Standard (LCFS), alleging that it violated the Commerce Clause of the U.S. Constitution because it interfered with interstate commerce. The California Air Resources Board adopted the standard in April 2009. The LCFS measured the level of greenhouse gas emissions associated with the production, distribution, and consumption of gasoline and diesel fuels and their alternatives. It was designed to cut the average carbon intensity of fuels by 10% over the next 11 years.
