A labor organization, an individual homeowner, and nonprofit organizations who identified themselves as the “intended beneficiaries” of the Solar for All program filed a lawsuit in the District of Rhode Island challenging the U.S. Environmental Protection Agency's termination of the program. They alleged that they would have benefitted directly from the program’s provision of new energy sources and its electricity cost savings. They asserted that the program’s termination violated the Administrative Procedure Act and was ultra vires, in violation of separation of powers and the Presentment Clauses.
