The Port of Oakland came to an agreement with the environmental justice group, imposing binding mitigation measures on the Eagle Rock Aggregates' project. Under the agreement, the Port must provide shore power to Eagle Rock docking locations by 2029 and Eagle Rock must transition to shore-powered vessels. To control air pollution, Eagle Rock must follow strict watering protocols for stockpiles, conduct moisture testing, and replace machinery with zero-emission models as the existing ones reach end-of-life. The Port also committed to abandoning use of its 2002 EIR for newly developed facilities, instead comparing any project's air quality impacts to existing conditions.

An environmental justice organization challenged the Port of Oakland’s approval of the Eagle Rock Aggregates Oakland Terminal Project and the supplemental environmental impact report (SEIR) for the project. The organization alleged that the project—a marine terminal that would import, store, and distribute sand and gravel—would result in increased air pollution and greenhouse gas emissions, among other impacts, and would exacerbate existing problems in West Oakland. The organization further alleged that the SEIR neglected whole categories of impacts, including analysis and mitigation of impacts on greenhouse gas emissions, fine particulate emissions, and energy.
