In October 2009, the Ukrainian public interest organization Environment-People-Law (EPL) filed suit against the government, seeking to compel the dissemination of information on international greenhouse gas emissions trading.  EPL specifically sought information regarding an agreement between Ukraine and Japan, where the Japanese government agreed to buy 30 million tons of carbon offsets from the Ukrainian government.  EPL contended that both the Aarhus Convention and the Constitution of Ukraine compels public access to the information.

On June 17, 2010, the Lviv Administrative Court ruled in part for the plaintiffs and in part for the defendants. According to the plaintiffs, the court ruled that the Cabinet of Ministers and the National Agency of Environmental Investments had acted unlawfully by failing to provide plaintiffs with information on international GHG emissions trading and ordered the defendants to provide such information. However, the court dismissed the plaintiff EPL's request for information on the price of GHG emission quotas as part of the emissions trading with Japan. EPL appealed this part of the decision. This decision was unchanged by the Court of Cassation.
