The court denied the United States’ June 30 request that default be entered against the Hawai‘i defendants because the defendants had not filed a responsive pleading by the June 23 deadline. The court noted that the defendants had filed an answer on the same day that the U.S. made its request and “[i]n light of State Defendants’ response to the complaint, albeit untimely,” the court denied the request for default.
