Delaware Riverkeeper Network v. U.S. Army Corps of Engineers

Delaware Riverkeeper Network and the Delaware Riverkeeper filed a lawsuit challenging a permit issued by the U.S. Army Corps of Engineers for a docking facility in New Jersey to transport liquefied natural gas (LNG) to docked vessels. The plaintiffs asserted claims under the National Environmental Policy Act, the Clean Air Act, the Administrative Procedure Act, and Corps regulations. Among other things, the plaintiffs alleged that the Corps’ public interest review “was arbitrary and capricious because it did not give sufficient weight and analysis to climate change impacts and safety concerns.”
