Sua sponte order issued holding plaintiffs' appeal in abeyance.
After the U.S. Supreme Court granted fossil fuel companies' petition for writ of certiorari in the City of Boulder and Boulder County Commissioners' climate case, the Appellate Division of the Superior Court of New Jersey issued an order holding the plaintiffs’ appeal of the February 2025 dismissal of the case in abeyance pending the U.S. Supreme Court’s decision in the Boulder case. The court also rescinded a February 20, 2026 invitation to submit supplemental briefs addressing the U.S. Environmental Protection Agency’s repeal of the 2009 endangerment finding for greenhouse gases. Oral argument previously had been scheduled for May 12, 2026.
