On May 25, Chevron Corporation removed the case to federal court, stating that the court had both original federal diversity jurisdiction and original federal question jurisdiction. Regarding federal question jurisdiction, the notice of removal asserted that the plaintiff’s claims implicated “uniquely federal interests” and were governed by federal common law, not state law; that the action “necessarily raises disputed and substantial federal questions that a federal forum may entertain without disturbing a congressionally approved balance of responsibilities between the federal and state judiciaries”; that the Clean Air Act and/or other federal statutes and the U.S. Constitution completely preempted the plaintiff’s claims; that the plaintiff’s claims were based on “alleged injuries to and/or conduct on federal enclaves”; and that the action necessarily implicated federal authority over the navigable waters of the United States and therefore fell within the federal court’s original admiralty jurisdiction. Chevron also argued that the court had original jurisdiction under the Outer Continental Shelf Lands Act and pursuant to federal officer and bankruptcy removal statutes.

Climate change can have a range of impacts on technological system. Extreme weather events can cause infrastructure failures like power outages or damage to roads and bridges, as well as the impacts from waste following natural disasters. Human activities also cause technological impacts, such as the risks posed by oil spillage and leaks.

Any substance with chemical properties that can cause physical harm to people or damage the environment, including ammonia, carbon monoxide, phosphine, chlorine, arsenic, cadmium, mercury, pesticides, dioxins, microplastics, benzene, asbestos, aflatoxins, fluoride, methanol, and toxins from marine sources.

Slow onset events evolve gradually from incremental changes over many years or from increased frequency or intensity of recurring events.
